So did someone on the Supreme Court leak to Obama that the Supreme Court might find ObamaCare illegal? If so, was it someone — Kagan — who used to work for Obama?

Federal judges can find Obama-Care illegal says Texas federal Judge Smith in response to Obama’s recent remarks about judicial review. It’s impossible to find ObamaCare’s individual mandate illegal said Obama. Oh?

But federal courts routinely strike down laws as illegal and unconstitutional. Today, Texas federal judge Smith bristles at Obama’s recent remarks on judicial review and that unelected men and women cannot — or should not — decide the fate of Obama-Care.

Texas federal Judge Smith rebuked U.S. Attorney General Holder concerning Obama’s remarks and requested within 48 hours a 3 page single space response concerning Obama’s position on judicial review.

The Supreme Court has always practised deference responded Eric Holder. Sounds like Holder thinks that the Supreme Court is supposed to rubber stamp whatever the Executive branch does.

Some of Texas Judge Smith’s prior rulings: Affirmative Action illegal and unconstitutional at Texas Law School. Obama’s 6 month moratorium on deep water oil drilling was found illegal.

NO to Obama-Care

President Obama accepts $1 million from Bill Maher [who calls himself a "a potty-mouth guy..." and who says his talent is "to get people to spill their fuc--ing guts out”]. That’s not exactly respectful language Maher uses to describe his audience.

Obama broadcasts his anti-conscience mandate that all employers including faith organizations will provide at no cost birth control pills, Obama telphones reproductive rights activist, Sandra Fluke. Obama publicly speaks out against Rush Limbaugh commenting, “No decent person would say…”

Obama says he leads by example. What example?

Think Machiavellian. Obama leads by the example of The Prince. “In the actions of men, and especially of Princes — from which there is no appeal — the end justifies the means.”

The Democrat controlled Senate recently voted down a law that would dismantle the heart of Obama-Care — the panel of experts that make all the decisions.

The way Obama-Care is set up, there will be no appeal from Obama-Care’s panel of 15 experts who decide your health care. No one except the panel of experts is trusted – not the patients who receive medical care, not the MDs and hospitals that provide care, not the taxpayers who pay for it nor the politicians who set up Obama-Care. No one is trusted except those who report to The Prince. How Machiavellian of Obama. How Prince-like Obama acts.

So, what can we do to remove Obama and repeal Obama-Care?

It will be citizens who collectively oust Obama & his policies and turn back the clock to the principles of those who wrote the U.S. Constitution and the Declaration of Independence.

Obama’s actions are in step with the Rules for Liberals by Saul Alinsky [dedicated to Lucifer aka Satan].

So now’s the time for conservatives to write a different book. Let’s call it, Rules for 2012 Conservatives.

Who are WE and who are THEY? Know that four out of ten Americans identify as ‘conservative’? Thus, in how Americans identify Conservatives are close to a majority.

And those who do not identify as Conservative [ who call themselves progressives/ liberals] are simply NON-Conservatives. They, unfortunately, lack conservative values and actions. In the Greece of Plato times either you were a member of the polis or you were a non-citizen and an outcast.

Yes! Conservatives recognize NON-Conservatives as members of the polis but the Rules will change from Rules for Radicals to Rules for 2012 Conservatives.

The NON-Conservatives are very different creatures form the liberals and Democrats of President Kennedy’s era. It was President Kennedy in the 1960s who said, ‘Ask not what your country can do for you, ask what you can do for your country.’

Today we have Democrat Party NON-Conservative Nancy Pelosi who tells congress they must vote for Obama-Care to find out what is in it. And we have Democrat Party NON-Conservative Harry Reid who, with the Democrats in the Senate, has not passed a budget in three years. And these NON-Conservatives refuse to OK the Canada to the Keystone XL oil pipeline. Well, these NON-Conservatives may hear loud and clear come November how the US Conservatives feel about the pipeline.

Rule 1 for US Conservatives: Know what makes NON-Conservatives like Pelosi, Reid, Maher and Obama ‘tick’. How? Read Rules for Radicals by Saul Alinsky. And also read The Prince. The Prince is all about the manipulation of appearances. The Prince appears compassionate but is not in reality.

Obama replaced the Bush terrorist policy of ‘capture & interrogate’ with Obama’s policy of ‘target and eliminate’. Obama, both personally and through his policies, has targeted numerous individuals and entities over the last three years.

Courts: With the U.S. Supreme Court present for the State of the Union address Obama upbraided the court for their ruling in Citizens United.

House of Representatives: Obama placed Paul Ryan front and center to castigate him for the Republican budget which focused on viable ways to re-structure entitlement programs.

Retired persons: Obama via the Federal Reserve targets and punishes savers and rewards spenders. When the wife of Romney said that their millions could be gone the next day there’s truth to what she says. A million dollars put into Treasury Bills for a year earns only $300 compared to $ 46,700 if the rate of return was close to what it historically has been.

Medicare recipients: Obama took $500 BILLION from Medicare and moved that money elsewhere. So, an entitlement program going broke goes broke even faster for the elderly. And those elderly will be the first to have their medical care rationed by the Board of Fifteen Experts appointed by Machiavellian Prince Obama.

So, speak up. Speak out. Contact other US Conservatives. Send email. Start blogs. Twitter away. Get a Facebook page and say what you stand for – and what you won’t stand for. Remember those 50+ times Obama reiterated “You can keep your doctor. And, you can keep your health plan…” Recently Health and Human Services Secretary Elizabeth Sebelius was asked about these promises Obama made to the American people about Obama-Care. The Secretary for HHS has no memory or knowledge that Obama made these promises. Is that collective amnesia? It’s acting with political expediency. Sebelius says she is ‘balancing’ the right to contraception with the right to religious freedom. Has Sebelius ever sat down and read the Bill of Rights?

Rule #3: Don’t follow the Rules for Radicals. Do follow the moral precepts that guided the founders of America.

1) Tie the Trojan Horse down. That is what the various law suits are all about. And the Supreme Court – of which several members are Catholic – will weigh in.

If via the Commerce Clause the Obama government can require individuals to purchase something just because the person is alive — where is the stopping point? If you can be required to buy one thing what else will be required?

2) Watch the Trojan Beast day and night, all the time. Remember what Nancy Pelosi said, that we must pass Obama-Care “to know what is inside”. Well, we know what’s inside Obama-Care and 2 or 3 Americans do not want what is there.

3) Like David did to Goliath, take aim with your slingshot and with one stone aim accurately and hit the Trojan Beast in the forehead. And hit hard. D That ‘rock’ is your personal fury at a Beast — the Executive branch of our federal government — telling you what you have to buy just because you are alive.

4) Thousands of ‘rocks’ that strike where Goliath or the Trojan Horse is most vulnerable can slay it. Citizens who contact their congress persons time and time again (even if those congress persons appear lame, seem deaf and act dumb), who FAX, who e-mail and who phone. And it will take money, time, diligence and care in how we interact with those we disagree. We are not going to back down — and we can listen as we disagree.

5) With your kids and liberal/progressive friends play a ‘friendly’ game of Obama-Care Beast. It’s a cool game that you make up as you go along. Will you slay the Obama-Care Beast or will it slay you?

To play Obama-Care Beast, you probably have most of the materials already: 2 dice, a pack of cards, a package of small ‘stickies’ of various colors, two pads of paper with strong cardboard, various plastic caps from milk cartoons and some small figures or animals. Each player picks a animal or figure to represent the person.

Another post outlines how to play Obama-Care Beast – Slay or be Slayed. This post may be updated with specific directions how to play the game. To give you the general idea:

Think of a basic board game – a square of cardboard. Just use the cardboard from the backs of two 9 by 12 pads of paper. You must choose your persona: adult, child, man/boy or woman/girl, Akin to Monopoly, if you land on certain spots bad things happen to you — i.e., you did not buy Obama-Care so pay the fine, you are too old for a pacemaker so accept pain medication instead, your medical condition is very expensive and, as you are not employed, you have to wait at the end of the line for medical treatment.

Obama-Care a Trojan Horse


Everything Obama can do we as voters can do better.

And do so with more honesty, courage and consistency than Obama has shown as President.

Obama has the bully pulpit. And he already is spending Obama-Care billions:

“The Obama administration will announce soon as much as $1 billion in funding to hire, train and deploy health-care workers, part of the White House’s broader “We Can’t Wait” agenda to bolster the economy after President Obama’s jobs bill stalled in Congress.”

Voters likewise can take up the bully pulpit. And, very importantly, join together with other like minded souls.

How voters can use their bully pulpit: First of all, start a blog and join other blogs who oppose Obama-Care. Use either WordPress.com or WordPress.org.And blog religiously — that means regularly.

Make the blog’s title clear that you oppose Obama-Care: No More Obama & repeal Obama-Care is the message. There are political Web Rings which you can join.

Several years ago, the conservative talk show host Rush Linbaugh started a campaign to slow down the crowning of McCain as the Republican candidate. That strategy is still valid for 2012.

As long as there is more than one candidate in the race Obama and his crew cannot focus a negative campaign on just one person. So, do what you can do so Rick Santorum and Ron Perry remain as viable candidates for as long as possible And they are viable, strong candidates. And they just might even win though considerably behind right now as of Feb. 2012.

Second, whatever your political leanings, if you oppose Obama-Care, go register as Republican. That way your vote counts in the primary.

Third, write (after appropriate professional consultation with your doctors)an End of Life Medical Directive stating that: a) you reject and want no part of Obama-Care; b) that you reject Obama-Care’s method of the rationing health care for the elderly; c) that you reject the use of ‘death panels’ making medical decisions for you or your loved ones.

Fourth, put a brief statement up on your blog stating that you oppose Obama-Care in its entirety. Send a copy to your Congresspersons.

Fifth, take a liberal/progressive neighbor out for coffee. And tell them how you as a neighbor feel about Obama-Care. Converse and listen to what they have to say. Get the message out to your neighbors and friends. Send e-mails.

Sixth, if you have not already, join a religious/ spiritual group in your community which has evangelism — the zealous advocacy of a cause — as an integral part of its’ Judeo-Christian mission. It’s easier to spread the word when you join with other who are like minded. And through that group, start a Health Care discussion which includes discussion of books and speakers.

Have you noticed that liberals/ progressives vilify ‘the evangelicals’ as an entity with extreme ideas which are out of keeping with modern values? Newspaper columnists typically talk about ‘the evangelicals’ as if they were one coherent group.

You might find “The Real Scandal of the Evangelical Mind” an interesting read. It’s available on Amazon.com and elsewhere. Written by Carl Trueman, a conservative theologian, Trueman pokes holes in the notion that there is any coherent evangelical mind. So, Carl Trueman a conservative theologian thinks that the entity does not exist what the progressives and liberals vilify.

In my view, evangelicals are part of many if not most religious groups.

Some newspaper columnists poke fun at Rick Santorum for holding core values which include opposition to homosexual marriage. For those who oppose Obama-Care it’s important that Santorum has core values and that he is willing to state what they are.

Think about where Obama formed his core values: Obama spent twenty some years in Rev. Wright’s congregation wherein the Rev. preached many ‘god damn America’ sermons.

Different from evangelism, the definition per Google of ‘evangelicalism’ is “the missionary, reforming or redeeming spirit evident throughout the history of Christianity in various guises or emphasis”.

Obama seems to lack the core beliefs in the Judeo-Christian principles that under gird America’s basic political documents — the Declaration of Independence and the Constitution.

Voters via blogs can focus on Obama’s core values which are antithetical — opposite to — the core values of the Declaration of Independence and our Constitution. Whereas our political documents look to God as the source of our freedoms, Obama looks to government as the source of people’s freedoms. And what government gives — government can take away. Obama never uses the words “endowed by their Creator” when he talks about basic individual freedoms.

Christian morality is steeped in belief and adherence to the Ten Commandments which include: ‘thou shalt have no other gods before me’ i.e., the worship of God is primary; ‘honor thy father and mother that thy days may be long ‘ i.e., that the children who honor their parents will themselves live to be elderly and frail; ‘thou shalt not bear false witness” i.e., don’t lie and ‘thou shalt not steal thy neighbor’s wife or ox’.

Obama’s behavior as President does not show adherence or belief in these basic Commandments. >

Does Obama honor the elderly and infirm? No. Obama puts no value on the life of a 95 year old grandmother who wants a pace maker. Obama said its better to just give old people pain pills rather than quality health care that is expensive.

Does Obama steal? Obama’s low interest money policies hurt savers and those living on fixed incomes. Who is that? The old. Obama in effect ‘steals’ from the old who saved for their retirement. Obama took [stole?] $500 million from Social Security to fund Obama-Care. That is taking from the elderly.

To summarize: Yes we can repeal the Trojan Horse of Obama-Care.

Let’s keep focused on the ball: repeal Obama-Care. That is the goal. And all sorts of things will flow from the repeal.

With no Obama-Care the government cannot wipe out private health insurance. With no Obama-Care the takeover of one sixth of the economy ceases.

Remember, Obama-Care — a Trojan Horse in our midst — already spends big bucks.

Who best will slay the Trojan Horse of Obama-Care? Romney the business man who pragmatically solves problems? Romney on the surface talks like a conservative but … Visionary Newt who defended Reagan and his policies on C-SPAN in the early 1980s for hours in the evening with the cameras rolling and nobody except a handful freshman Republicans there? Energetic and no baggage Rick Santorum who socked it to Romney on Romney-Care and who strongly opposes Marxist and socialists world wide?

You got to admit that the MD old man Ron Paul knows from personal experience how government has harmed the practice of medicine. Ron Paul is worth 2-3 million and has zero money in stocks. Paul has his money invested in gold.

So more than likely Paul would support a strong dollar and return to the gold standard. What about a Ron Paul and Rick Santorum ticket?

How to teach your child Digit Span a task measured by many I.Q tests


How to increase the IQ of all children? Especially children with ADHD or Autistic Spectrum difficulties?

This technique to raise IQ applies to all children. It can be especially helpful for children with difficulties with focus, attention, sequencing, executive functioning and ‘working memory’ difficulties. Children with those difficulties are often labeled as having ADHD or Autistic Spectrum difficulties.

Can your child’s IQ be changed? Of course. Can parents and relatives help? Yes! And to raise your child’s I.Q. you don’t need Obama-Care, the U.S. Department of Education nor permission from any federal, state or local governmental entity.

How to raise IQ? Teach to the test. Well, not exactly to the test as IQ tests are proprietary information which test makers and test givers protect. But it’s fine to teach the general tasks measured by many I.Q. tests.

All good teachers teach to the test in some sense. Take the teaching of math.

Everyone knows that 5 + 4 =9 and not 8 or 10. There is one correct answer. If you want a child’s math abilities to increase you have to practice. And if you want them to remember – make it fun.

It’s the same for raising IQ. Teach the general tasks that are tested by IQ tests. And make it fun so they remember and want to learn the tasks.

So, let’s start with one way to strengthen a child’s ability to focus and pay attention.

Digit Span: Measuring digit span abilities is one task which is part of many IQ batteries. So how can this ability become stronger for all children? And is it an important task?

Why teach Digit Span? Every kid needs to learn their phone number including the area code. For safety reasons children should be able to state a telephone number so that an adult can be alerted. So, learning a series of digits is an important, useful task. So, how can we make an important task fun. See how below:

Take my telephone number for example. 831 216-6002 [Please do not call it!] Here’s how to teach a child to learn their telephone number digits:

Get a lined pad of paper and in a column write: 0 at bottom, then 1,2,3,4,5,6,7,8.9 Next, draw dots next to the numbers. And then connect the dots with lines.

Look at the visual image how the dots are connected. That visual pattern is what you want your child to learn. You can see the visual pattern in the image at the top of this post.


Is your child a stronger visual learner? A lot of kids with ADHD and autistic spectrum difficulties are stronger visual learners than they are verbal learners. That means if the child can see what to do they can learn it faster than if they just hear what to do.

Now make learning the telephone number digits fun:

Use sounds to teach telephone number/ Digit Span to child


Try different methods: For example, 1) try using a xylophone and see if music helps cement the digits together for your child. Or 2) try using a different color pens for each digit. One is red, two is blue, three is yellow. Always be consistent so color becomes associated with the number. Or 3) try just drawing the pattern over and over again.
You know your child’s strengths so play to those strengths. Make it a fun activity.

How to start? Small chunks. Teach it in two chunks – the first three digits and then the remaining four digits.

Once a child can learn 3 digits forward, teach those digits backwards. 2-1-6 and 6-1-2. Why also teach backwards? That strengths the visual and auditory memory systems.

Just like push ups strengthen physical muscles learning visual and auditory patterns with numbers strengths your child’s focus, attention and concentration. Your child is having fun doing something with you. And, your child is ‘growing’ his or her I.Q.

Pediatricians frequently recommend medications, e.g., Ritalin, Concerta, to assist with attention, concentration and focus. Research shows that a combination of medication (if they work) and cognitive-behavioral therapy for child and family provides the best results.

In my clinical experience, it only takes one concerned, involved, consistent adult to dramatically affect the overall development of children with various disabilities. So this technique can be used by an older brother or sister, aunt or uncle or grandparent. Sometimes the parents themselves have disabilities such that they are not the ideal person to help ‘grow’ their child’s I.Q.

Below is the real story of a young person whose I.Q. could grow if… [personal identifying information has been changed to protect privacy].

Jose is age 17 and a twin. His brother has been diagnosed with mental retardation. Jose’s father is in prison. Jose has an older sister diagnosed with depression. Jose’s mother has various physical disabilities and receives social security, disability. Jose has one older sister who is completing college, has a job and has a boy friend. This sister has been a positive, involved person in his life. This sister is the main person who takes Jose places, listens, helps him set goals and complete tasks. Jose’s teachers over the years report that he shows substantial difficulties with attention, concentration and focus. Jose’s pediatrician tried Jose on five different medications without success. County Mental Health referred Jose to a local counseling service where he received one-to-one therapy from a therapist to address ADHD. Jose’s cognitive I.Q. abilities to think abstractly visually and verbally are in the Low Average range. When Jose’s “working memory” abilities are tested they are low, i.e. in the Deficient range.

Can Jose’s ‘working memory’ be improved? I think so. If there are concerned adults that stay involved with Jose.

NOAA federal agency that oversees whale protection is no Noah's Ark


Obama’s federal agency NOAA is no Noah’s Ark.

Pronounced like Noah, the federal agency NOAA stands for National Oceanographic and Atmospheric Agency. NOAA’s funding is authorized by the Department of Commerce.

Per how NOAA recently acts as judge, jury and prosecutor against people using the resources of Monterey Bay — huge fines for jet ski users and criminal charges against a biologist for feeding large fish — it may be the right time that the public jerked NOAA’s funding to a standstill?

Interestingly, Democrat congressman Sam Farr refuses to comment on NOAA and has refused to go on a local radio program, KSCO 1080 radio, to discuss NOAA.

Sam Farr is the same Democrat congressman who, when he held four Town Meetings on health care, stated at the beginning that he was there to tell the public that he was going to vote for Obama Care. Sam Farr was not there to listen – he was there to tell the public what he was going to do.

Let’s look at the considerable differences between Noah’s Ark and NOAA’s Mission:

You know the Biblical story: Under God’s direction, Noah built an Ark and put on board two of every kind of animal. When the world flooded, the animals were safe on board the high seas until, finally, a little bird brought back a leaf. The leaf signaled to Noah that land was near and life could go on. And God gave to people the rainbow as a sign that never again would God flood the earth with water.

Today we have NOAA to save the animals, fish, birds and everything from the bottom of the sea all the way to the sun. What a huge charge. And what huge powers turned over to Obama’s political appointees who run NOAA.

Note that NOAA operates under the Commerce Department. According to the 1942 Supreme Court case of Wickard v Filburn, the Commerce Department can set quotas forbidding a farmer to grow wheat used for his own consumption.

It is that same Supreme Case – Wickard v Filburn — that President Obama will use to defend Obama-Care’s mandate that all individuals must purchase health insurance.

This is the Mission Statement listed on NOAA’s website:
“NOAA’s mission is to understand and predict changes in the Earth’s environment, from the depths of the ocean to the surface of the sun, and to conserve and manage our coastal and marine resources.”

Three vessels charged with violating Right Whale ship strike reduction rule pay penalties
Speed restrictions in seasonal management areas reduce risk of death to endangered whales
January 10, 2012

Right whales
Three large commercial vessels who were assessed civil penalties this fall for violating seasonal speed limits designed to protect one of the most endangered whale species in the world have paid their penalties in full. Cases against six other vessels for the same offense are still open.
The ship strike reduction rule, enacted in December 2008, restricts vessels of 65 feet or greater to speeds of 10 knots or less in seasonal management areas along the East Coast to reduce the chances of North Atlantic right whales being injured or killed by ships.
Notices of Violation and Assessment (NOVAs) were issued Nov. 21 by the NOAA Office of General Counsel’s enforcement section to owners and operators of vessels that allegedly traveled multiple times through the seasonal management areas at speeds well in excess of the 10 knots allowed under the regulations.
The alleged violations occurred between November 2009 and January 2011 outside of New York City; Charleston, S.C.; Brunswick, King’s Bay and Savannah, Ga.; and Mayport, Fla.
One vessel was charged with 16 counts of speeding. Vessels’ documented speeds ranged from 13 to 18 knots, and the vessels traveled these speeds for as many as 26 nautical miles.

Each count in the NOVAs was assessed at $5,750, resulting in total penalty assessments ranging from $11,500 to $92,000. None of the vessels receiving NOVAs had prior violations.
The owners and operators had 30 days to respond either by paying the penalty, seeking to have it modified, or requesting a hearing.
Compliance with this rule is critically important for preventing right whale extinction. Ship strikes are the leading source of human-caused mortality for right whales, and together with entanglements in nets, are slowing the recovery of this critically endangered species.
Biologists believe that there are as few as 396 right whales left in the North Atlantic Ocean. Right whales are protected by the Endangered Species Act of 1973 and the Marine Mammal Protection Act of 1972. The death of even one whale can be devastating to the right whale population. NOAA estimates that a female right whale will need to give birth to four healthy calves over her lifetime to successfully replace herself within the population.

Ten Commandments guide behavior versus 1500+ Rules for Obama-Care

In the Ten Commandments there are 10 or so Thou SHALT NOT ….[steal, murder, bear false witness, covet].

In Obama-Care — alias the Affordable Care Act — there are 1,563 “the Secretary SHALL”.

Think of that — 10 Rules for civilized behavior versus 1,500+ Rules to control medical decisions.

The Mercatus Center at George Mason University evaluated all major Obama-Care rules that cost over $100 million a year. All of the Obama-Care rules scored F’s — some lower but all F’s.

Messrs. Conover and Ellig conclude that regulators working on deadlines usually resort to “analytical shortcuts, leading to lower-quality decisions.” The Bush Admin. post 9-11 regulatory overload was no great shakes. But at lest there in the White house was working to protect national security rather than usher in a new social and economic order through the Federal Register.

Mr. Obama has made clear that the rules will keep coming, but at least his team could try to write good bad rules Probably too much to ask.

“There is more good in the budget deal than is revealed in the budget cut number agreed on last night. Measured against the size of budget cutting necessary for the future, the numbers are small, to be sure, but this number was a tactical, not a strategic engagement. The key to the matter is momentum, principle, and precedent, which set up the strategic environment for 2012.

Andrew Stiles at NRO correctly points out the extent of the Harry Reid cave-in.

“Senate Majority Leader Harry Reid (D., Nev.) didn’t want to cut anything at first. But bowing to political reality, eventually ponied up about $4.7 billion in cuts. He ended up with $33.8 billion less spending than he wanted. And he called it an “historic” accomplishment. (Not surprisingly, the left is appalled).

House Speaker John Boehner (R., Ohio), on the other hand, initially proposed $32 billion in spending cuts. House Republicans, led by an undaunted freshman class, bumped that number up to $61 billion ($100 billion off the president’s budget), before settling on $38.5 billion.

“That’s $6.5 billion more than Boehner asked for to begin with, and $5.5 billion more than the $33 billion that Vice President Joe Biden and Senate Democrats claimed had been agreed to less than two weeks ago.

Obama even admitted in his speech infrastructure projects were being ‘delayed’ (i.e., de-funded in 2011). Once de-funded, they will not be back any time soon. As fox News reports, this is a lot farther than the Democrats said they would be willing to go when this all started. (snip)

However, Boehner must have had an incredible stick in those negotiations, because Reid and Obama agreed to put things to vote in the Senate which everyone deemed impossible just last week. That is the truly amazing part of what Boehner pulled off yesterday:

The last thing Reid or Obama want is a vote in the senate on Obamacare (or Planned Parenthood). But now they are going to have to vote and this is huge. If this happens, and 4 of those 23 red-state Democrats up for reelection in 2012 vote against Obamacare, then the President will have to veto a bipartisan bill that lines up with the overall will of the American voters. What could be better than isolating Obama and Obamacare from the will of the people and Congress heading into 2012?

The conclusion is inescapable that the Democrats realized they would be blamed for a shutdown, at least as much as the Republicans. The ploy of holding the troops’ paychecks hostage stands as one of the dumbest political moves of the Obama presidency (and that is saying a lot). Sure there would be pictures of families turned away from the Washington Monument, but these would pale in comparison with the pictures of families near military bases unable to pay the rent or buy groceries, going into paycheck advance lenders and payting 22% interest in order to put food on the table.

One thing the American public will not tolerate is using our brave military heroes as political pawns. A.F. Branco summed up the politics thusly:

The Opinion piece, Regulating ‘Mental Activity’ (WSJ 2-28-2011) disagrees with the latest judge, Gladys Kessler, who holds that Obama-Care is constitutional.

It’s time that the public understands the slippery thinking displayed in Wickard v Filburn — the legal case used by the Obama Administration and Judge Kessel to defend Obama-Care. It’s time that the thinking public read Wickard v Filburn. From this case has come the huge expansion of the federal government into so many aspects of American life.

The lack of logic which the judge employs is mind boggling. It’s time for rational thinking people to take up pen and write the judge, her boss and various associations that represent organizatons that have knowledge about “thinking”, “mental activity” the “mind” and the difference between doing an act and thinking an act. To consider action as the same as inaction wipes out all sorts of legal, ethical and psychological distinctions that have been around a thousand years or more.

The mental activity of decision making when a person thinks, “I will buy health insurance… or “I will not buy health insurance” is economic activity which the government under the Commerce Clause can regulate says Gladys Kessler of the D.C. district court. ”

The distinction between activity and inactivity is “of little significance,” Judge Kessler writes, “It is pure semantics to argue that an individual who makes a choice to forgo health insurance is not ‘acting’…Making a choice is an affirmative action whether one decides to do something or not do something. They are two sides of the same coin.”

Every organization of professionals that has some knowledge of mental activity — psychologists, psychiatrists, marriage and family counselors — needs to speak up and discuss what Judge Gladys Kessler says.

This is not just about Obama-Care and whether it is constitutional. Did the government of our Founders create a government whose reach includes “mental activity”?

Is the mental activity, “I will kill my neighbor..” the same as “I will not kill my neighbor” and if the decision is based on stealing my neighbor’s jewels — an economic activity — can the government take action against me for thinking thoughts about murder as opposed to the activity of taking steps and acting on my thoughts?

To repeat the judge’s words, The distinction between ACTIVITY and INACTIVITY is “of little significant” …. Think of the Ten Commandments: Thou shalt not steal, commit adultery, murder… There is a huge difference between DOING the act and thinking about the act. For doing the activity of intentionally killing a person society punishes people and ostracizes them.

Let’s say that I believe that Judge Kessler is irrational and should be removed from her position as judge. Here I am engaging in mental activity. And, let’s say I act by writing a letter to her “boss”. By writing I am engaging specific, identifiable action to achieve a particular result. And let’s say I send money to professional associations such as the American Psychological Association (APA) to take up pen to comment on the lack of rationality shown by this judge.

In contrast, let’s say that my husband totally disagrees with me. And he takes no action except to think, “I’m taking no action and doing nothing.” Is his lack of action the same as my actions — just two sides of the same coin? When is LACK of action ever the same as ACTION? Judge Kessler thinks they are the same.

Remember Wickard, the farmer who kept 148 bushels of wheat and did not put them on the open market. That is the legal case, Wickard v Filburn, from where all this stretched to the edge of illogical thinking arose. The government relies on the Wickard decision to say that thinking about an action is the same as taking the action. This is a stretch that breaks the elastic. Read the case for yourself and think of how slippery the sloop is — from 148 bushels that were hoarded by one farmer for personal use to NOT buying a product that crosses state lines.
