A victim wearing a Halloween costume in Pennsylvania was attacked by a Muslim, Talaag Elbayomy. The attacker said that the Halloween costume was a version of the Prophet Muhammad and hence the attack was justified.
The attack was recorded on film and witnessed by a police officer. The police promptly arrested the assailant, who was later charged with harassment.
But, as legal scholar Jonathan Turley notes in his blog, the judge who heard the case dismissed the case on the grounds that the offense to Islam was not protected speech.
