“Enough Is Enough!â€
That’s what many California State employees are saying.
Fed up with the rising costs of mediocre Union representation, and SEIU’s lack of transparancy, they have chosen to resign from SEIU and pay only “Fair Share†fees. State workers can Resign from SEIU by submitting the form in Step #1 below, entitling them to save ~2.4 % of their union dues.
If you feel that SEIU is spending your Fair Share fees on non-Union issues (Non-Germane), you can save up to ~45% of your dues by submitting a Non-Germane Objector form in Step #2 below.
Are there any risks in resigning from SEIU?
Per Federal and State laws, you must still be represented by the existing Union. The only real difference between being a member and not, is the loss of the ability to vote on internal Union issues, but you will still be able to vote in elections to Decertify the existing Union.
What if there is a labor dispute with my employer?
According to the Dills Act, and other government codes, including:
Government Code [3515.7]
The Exclusive Representative (the Union/SEIU) must represent members and Fair Share Fee payers exactly the same, no different. “A breach of this… will have occurred if the Union’s conduct is Arbitrary, Discriminatory, or in Bad faith.â€
Step 1: Resign Your SEIU Membership

SEIU petitioned the state and won the ability to charge non-members for the benefits they enjoy at the expense of members. These charges are known as “Fair Share†fees, and amount to ~98% of the standard Union dues. Submitting the Membership Cancellation form will make you a “Fair Share†fee payer, and you will lose the ability to vote in SEIU matters (but you will still qualify to vote for a new Union).
This Membership Cancellation form needs to be submitted only one time, but if you will be submitting a Non-Germane Objector form in Step #2 below we recommend you submit this form with it. Doing so will eliminate any question as to whether you are a Fair Share fee payer, which is a requirement for filing the Non-Germane form.
Step 2: Apply For Non-Germane Objector status
[Fair Share vs Hudson Objection (aka Non-Germane Objector)]
Some Union Fair Share fee payers (Hudson) objected to paying for Union participation in political causes that conflicted with their own political beliefs, including the Unions pursuit of causes that were non-germane to Union representation. These Fee payers felt they shouldn’t be forced to pay for the Unions involvement in the Non-Germane cause. The courts agreed with Hudson, and Fair Share Fee payers were awarded two powerful rights, as Non-Germane Objector’s:
1) The right to Object to being forced to pay for the Union’s involvement in Non-Germane activity (and therefore stop paying that portion of the Unions Fair Share Fees).
2) The right to Challenge the Unions calculations of the Non-Germane portion of their Fair Share Fees. The challenge must be arbitrated in a timely manner and at a location near you. The Union must prove the validity of their charges.
This Non-Germane Objector form must be filed in June of every year. Any forms postmarked before or after June will not be valid. To avoid the invalidation of Non-Germane forms that may be submitted before or after June we will only post this form here from June 1st to June 30th.
* You must be a non-member aka “Fair Share†fee payer to submit this form. To avoid any controversy as to whether you are a “non-member†or not, submit both forms below together:
1) SEIU Membership Cancellation Form (Available Now!)
2) Non-Germane Objector Form (Available again June 2011!)
Membership Cancellation Form and Non-Germane Form will only be available from June 1 – June 30.
Forms must be Postmarked in June to be Valid.
To avoid delays please submit your forms ASAP!
Both above forms should be submitted simultaneously (June 1 – 30).
