Federal agency National Oceanographic & Atmosphere Administration (NOAA) recently pressed criminal charges and has levied huge fines against a nationally known biologist for feeding large fish.

Also, NOAA recently levied enormous fines — which keep going up — against two persons using jet skis to save surfers in Monterey Bay.

The overall issue is that a federal agency (NOAA) under Obama and with the blessing of local congressman Sam Farr now controls access of the public to use of Monterey Bay. Do you accept this control?

Because the jet ski users are contesting the charges, NOAA’s response has been to double and triple the fines. Per discussion by Dr. Bill on radio 1080, NOAA is acting as judge, jury and prosecutor and not allowing any defense.

Sam Farr, congressman for the Monterey and Santa Cruz, CA area, refused to come on a local radio show Saturday, Jan. 14 and discuss his views of NOAA and the legal charges against people using the Monterey Bay for work and play. Sam Farr’s office likewise did not contact the radio station. Farr’s offices were contacted repeatedly without success.

“Put a sign on your car, in your window and on a telephone pole telling Sam Farr what you want” says Dr. Bill on 1080 Radio. “Or just write, Sam Farr — Farr Out!”

NOAA’s senior positions are filled with political appointees who push for the political agenda of the current administration. Dr. Bill refers to NOAA as the “green Gestapo”.

Per the 1080 radio show Jan. 11, 2012 NOAA spent millions of Obama Stimulus money on a new building close to the beach at Asilomar CA state park in Monterey, CA. NOAA will not permit any non-native plants in the area and has built a building which, to put it mildly from the comments of listeners to the raido show, does not blend into the environment. How parents can help ADHD & Autistic children be happier & achieve goals

Some simple techniques can assist children with attention deficit hyperactivity disorder (ADHD) and/ or autistic spectrum disorder (ASD)to be happier and achieve appropriate goals. These techniques are easy for parents and teachers to implement.

Of course a child is not a car but think of the following analogy:

Every car to get to a destination needs a driver. Parents can assist children to get into the driver’s seat and drive their ‘car’ to appropriate ‘destinations’.

Here’s how to assist children who have difficulties with focus, attention, concentration, ‘executive functioning’ or ‘working memory’ difficulties. Executive functioning and working memory are words used by school psychologists. What the parent sees is a child who can’t seem to figure out what comes first and appear disorganized.

What to do: Get a pad of 8 by 12 inch lined paper.

On one per sheet of paper —
1) Write at the top, a Goal that parents/teachers want the child to achieve.
2) Write out all the Steps required to accomplish the Goal.
3) Order the steps from first to last using KISS (Keep It Simple, Simple)
4) Figure out an appropriate Reward for child accomplishing the steps.
Set it up so child can get partial reward for partial completion.
5) Decide the number of Days child needs to complete the Goal.
6) Draw up a Graph with Days across Top of Page and Goals listed on left.

Here’s an example of a Behavior Plan for a child who shows symptoms of both ADHD and ASD:

Gina is 8 years old and was exposed in utero to illegal drugs and alcohol. Her biological mother lost parental rights and Gina has been in foster care since age two. Since age four, Gina has received County Mental Health therapy and medication to assist with focus, attention and concentration. The therapy provided by County Mental Health focuses only on helping Gina to label emotions and better express her emotions appropriately.

Gina’s foster mother and her teacher agree that Gina’s adaptive functioning abilities are considerably below what they expect for her age. Her foster mother wants Gina to 1) wash her face & brush her teeth; 2) make her bed; 3) put toys in basket in her room; 4) set the table with utensils and plates before dinner.

    Goals:

Monday Tuesday Wednesday Thursday Friday Saturday Sunday
Wash face & clean teeth
Make bed
Put toys in basket
Set table with utensils & plates

Spiritual/ religious beliefs need to be integral to a successful Behavioral Plan.
For example, Gina’s foster mother goes to church and rests on Sunday. Therefore the behavior plan is for six days a week and no work on Sunday, their day of rest. Six days a week time four goals = 24 Goals for Gina to achieve. For each Goal achieved she earns one (1) dime. During the week she puts stickers on the sheet and gets her motivators (dimes) which she puts into a plastic, clear jar. That way she can see exactly what she has earned towards a new toy on the weekend. Her foster mother believes Gina can find age appropriate toys for around $2.50 to $3.00 a toy.

What makes a Behavioral Plan successful?
The answer is simple: practice and more practice so the Steps are as simple as possible and the child gets rewarded for partial and then complete finishing the Goal.

For example, Gina when we started could not make her bed said her foster mom. Well, the cover was too big and too heavy for a thin, small 8 year old to move around. Thus, by simplifying and making a bed simply tossing a light duvet (down comforter) on a twin bed and putting the pillow in place — then making a bed by an 8 year old is simple and possible.

A second example:
Gina has never set the table for dinner. Part of the reason is that the plates are too high for her to reach and they are china easily breakable. Also, the utensils are not easy to get to. This is easily solved by moving plastic plates and smaller folks and spoons to one drawer that the child can reach. The point is to set it up so the child can successfully achieve the Goals.
Overall point: Parents can set simple ‘destinations’ for their child to drive their ‘car’ towards and by keeping the steps simple and practising the steps again and again their child can achieve those destinations to goals that parents set.

Very important: the hugs and ‘You did great!’ and ‘Keep trying!’ are as important and at times more important than any reward system. Parents – whether biological parents or foster parents – are the fire to ignite important, life long change in children.

Many CA children are wrongly diagnosed by reputable institutions such as Stanford Hsoital (LPCH) with Intellectual Disability/ Mental Retardation.

Read the story of Maria below. To make a referral to Stanford hospital ( LPCH) as County Mental Health did with Maria is simply wrong. County Mental Health actions — and lack of actions — harm children who deserve better.

Maria’s story is not unusual. The story describes how many children are routinely mis-diagnosed by Stanford hospital (LPCH). Information concerning Maria and the actual parties involved have been changed or not specified to maintain privacy.

Maria, not the child’s real name, was for real exposed in utero to multiple illegal drugs. And as is true for many children exposed in utero to drugs, Maria, now age eight, has substantial difficulties that affect her overall development. Front and center, she has substantial difficulties with with executive functioning, attention and concentration.

Maria was removed at birth from her biological parents. She lives with a foster mother who only speaks Spanish and a handful of other children. In the home, she has no daily chores and prefers to play by herself. For the last several years, Maria has received County mental health services (medications and therapy) to assist with her dificulties related to inutero drug exposure.

In the home, Spanish is the principal language spoken by the foster mother. At school, Maria’s special education classes (SDC) are in English. Maria speaks a mixture of Spaish and English. For example she know shapes (circle, rectangle) and colors in English but not Spanish; on the other hand, she knows animals and and common home items better in Spanish.

Through her public school, Maria’s cognitive abilities have been assessed in Spanish, English and also with non-verbal tests. At school, she performs best on non-verbal, visual tests of intelligence that have less cultural bias. Assessed on multiple occasions, Maria performs variously. On I.Q. tests that do not rely on lanugae she performs in the Average to Low Average range.

County mental health gave Maria a diagnosis of Pervasive Developmental Disorder, Not Otherwise Specified (PPP-NOS). Saying that they sought more ‘diagnostic clarity’, the County recently referred Maria to Lucile Packard Children’s Hospital (LPCH) located in Stanford, CA.

Though County Menal Health initiated the referral to Stanford hospital (LPCH) they did not send along their own mental health records. The Mental Health therapist or psychiatrist could have put relevant mental health summary records in an envelope and given it to the family to take with them. That did not happen.

Nor did County Mental Health assist so that relevant school psychological assessments accompanied their referral to Stanford hospital (LPCH). With a Release signed by the mother the County Mental Health therapist could have ensured that school assessments accompanied the County’s referral to Stanford hospital. That did not happen.

As a result, there was no collaboration between County Mental Health, the local schools and local physicians. As a result Stanford hospital (LPCH) lacked up-to-date relevant records available for review. Very importantly, and one wonders about arrogance by Stanford hospital, LPCH routinely does not seek out additional information other than what it gets from their own assessment.

The family had to travel two to two and a half hours each way to go to Stanford hospital (LPCH). Although there are numerous licensed psychologists trained in assessment and diagnosis the County routinely chooses to refer outside the County to LCPH. If they wanted to, County Mental Health could reaadily refer to the local Psychological Association. Every County in CA has a psychological association.

Maria was recently assessed by Lucile Packard Children’s Hospital (LPCH). Of importance, the LPCH assessment did not request nor review Maria’s multiple prior school assessments. And LPCH did not review Maria’s medical records nor her mental health records.

LPCH limited the assessment of Maria’s current functional abilities to the ratings that they obtained that day from Maria’s foster mother. No ratings were obtained from Maria’s teachers. Based on a one day assessment, done in English using a Wechsler IQ test known to have strong cultural biases, LPCH gave Maria diagnosis of Intellectual Disability/ Mental Retardation.

Yes this 9 year old child suffers from dificulties related to in utero drug exposure. And she has not yet stabilized her language abilities because she hears only Spanish at home and English at school. And yes on certain tests of executive functioning, attention and concentration she scores quite low.

Maria and other children referred by County mental halth deserve an accurate diagnosis based on a thorough review of relevant school, medical and mental health records. County mental health should collaborate with local psychological associations and use locally trained psychologists who can visit schools and observe children in their home enviornment. When referring outside the County, County Mental Healh should see that relevant school, medical and mental health records accompany their referral.

As I wrote above, to make a referral to Stanford hospital ( LPCH) as County Mental Health did with Maria is simply wrong. County Mental Health’s actions and lack of actions harm children who disserve better.

With an erroneous diagnosis in hand, County Mental Health will close Maria’s case saying that her supposed diagnosis of intellectual disability makes it impossible for her to profit from therapy. And with this diagnosis the schools probably will refer the family to social security.

What Maria truly needs is: 1) time to develop and stabilize her language abilities; 2) training in how to use schedules and other techniques that assist persons with problems with attention and concentration. Just because this eight year old tends to skip from step 1 to 4 does not mean she cannot learn to do tasks correctly. With correct interventions, Maria will be happier and society will not have to support her as an adult.

Ponzi schemer Scott Rothstein said his downtown Fort Lauderdale law firm maintained a condo across the street where he and his law partners would have sex with prostitutes and then come back to work, according to transcripts of his testimony that were unsealed Wednesday.

The imprisoned fraudster said his law firm spent tens of thousands of dollars per month on escorts, offering the women’s services to friends, investors and business associates.

“There were probably times when we spent $50,000, $60,000 a month on escorts,” Rothstein said. “It just depends. When there were political things in town, more. Big functions, conventions, more. People in town to entertain, more money. But it was a lot of money just for the law partners that were using escorts. Some of them had fairly voracious escort habits.”

Two jewelers were convicted in May of scripting and acting out an elaborate plan to steal their own baubles for the insurance money. Now they will spend between 20 months and 5 years in jail.

The biggest blunder was their inability to disarm their own security cameras. The failed attempt was, ironically, caught on tape. As cameras continued to defiantly roll, we see the pair removing the contents of the safe before the “burglars” even arrive, and then place the empty boxes back inside for the crooks to confiscate.

In the next scene the two hired accomplices — dressed as Hasidic Jews and armed with plastic guns — are buzzed in without even being asked, “Who’s there?” Spoiler alert: The stolen goods have not been recovered, and the costumed extras have.

A jailbird who was so outraged over what he felt was his lawyer’s shoddy representation of him in court sued the attorney — but he couldn’t remember the guy’s name.

So the fuming felon filed a federal suit against “I Don’t Know My Lawyer’s Name” for the truly astounding sum of “one houndred dollarys” in damages.

Some portions of Wilfredo Rodena’s self-filed suit against “I don’t know” are incomprehensible, but he filed the action as part of a civil-rights bid to overturn his 1989 conviction for kidnapping a young woman at knife point.

In his Manhattan federal court filing, Rodena claimed that “I don’t know” and he did “not fight for me at all. He did not said one word in my behelf.”

The suit also names Bronx District Attorney Robert Johnson — whose name Rodena spelled correctly — and says, “the stenographer is envoled to. But I don’t no her name.”

Instead of typing, Rodena said, “All she did was Smirk at me. And kept her fingers over the machine, and never typed one letter.”

And now I’ve just learned that the Big Boy in publishing — Amazon — has put in place new policies that seek to wipe out competitors such as SmashWords.com

Amazon does amazing things. And this is amazingly wrong. Please tell Amazon to ‘back off”.

“Amazon yesterday launched a broadside against competing ebook retailers when it introduced a new program that requires authors to remove their books from competing retailers.

The new service offering, KDP Select, promises participating authors a shot at earning their share of a $500,000 monthly pool of cash. Amazon will distribute the funds to participating authors based on the number of times an ebook is borrowed from Amazon’s new lending library.

To entice indie authors, Amazon’s FAQ notes that if the author’s book accounts for 1.5% of the downloads during the monthly lending period, they’ll earn 1.5% of the pot, in this case $7,500.

But there’s a catch. Actually, there are multiple catches as outlined in Amazon’s Terms and Conditions for the program. Some carry potential anti-competitive and restraint-of-trade implications.

•From the time an author enrolls their book in the program, they cannot distribute or sell their book anywhere else. Not the Apple iBookstore, not Barnes & Noble, not Smashwords, not Kobo, not Sony, not even the author’s own personal blog or web site. The book must be 100% exclusive to Amazon.

•If the author violates Amazon’s exclusivity terms at any point during the three-month enrollment period, or if the author unpublishes their book to remove it from the program so they can distribute the book elsewhere, the author risks forfeited earnings, delayed payments, a lien on future earnings, or could face termination of their Kindle Direct Publishing account.

•The author’s enrollment, and thus their liability to Amazon, automatically renews every three months if they fail to opt out in time.

Let’s examine the broader implications of this new program, not only for authors but for the nascent ebook industry as well.

Impact on authors:

•Forces the author to remove the book from sale from the Apple iBookstore, Barnes & Noble, Sony, Kobo, Smashwords and others, thereby causing the author to lose out on sales from competing retailers.

•By unpublishing a title from any retailer, the author destroys any accrued sales rank, making their book less visible and less discoverable when and if they reactivate distribution to competing retailers.

•Makes the author more dependent upon Amazon for sales. As authors increase their dependence upon Amazon and lose sales from other retailers, they risk becoming tenant farmers on Amazon soil. As history buffs may recall, the great Irish Potato Famine was a result of over-dependence on a single crop grown on soil owned by a single landlord, exacerbated by government policies favoring landlord interests over human interests. Most indie authors would be smart to diversify their crops across multiple retailers.

•Amazon has modified the Kindle Direct platform’s user interface with the effect of making it almost difficult not to enroll a book, lest the book’s account setup appears incomplete. Where they once placed their pull down menu for managing a book’s settings, they’ve now placed the enrollment link. The pull down settings menu is moved to the bottom of their dashboard.

Impact on readers:

•Books enrolled in the Amazon program will be removed from all other retailers, thereby forcing readers to patronize Amazon if they want to sample or purchase the book.

Impact on competing retailers:

•Harms other retailers by denying them the ability to sell the author’s book.

•Many authors will permanently stop distributing to Amazon’s competitors once they become fully dependent upon Amazon for the lion’s share of their earnings.

•Motivates more customers to purchase at Amazon since Amazon has this exclusive content.

•Discourages formation of new ebook retailers around the world by making it more difficult for new retailers operating outside the US to gain footholds in their respective markets if they lose fair access to the content readers want to read.

Program Limits Competition, Restricts Opportunity for Authors

The new Amazon KDP Select program reeks of predatory business practice. Amazon is leveraging their dominance as the world’s largest ebook retailer (and world’s largest payer to indie authors) to attain monopolistic advantage by effectively denying its competing retailers access to the books from indie authors. Some of these retailers supply international markets or power the ebook stores of other retailers outside the US, so Amazon’s terms harm non-US retailers at a time when Amazon is opening stores in those same countries.

More importantly, the KDP Select program harm authors by limiting their sales opportunities at competing retailers. Since Amazon controls anywhere between 60 and 70% of the ebook market, some authors may underestimate their lost sales opportunity. Their participation in the KDP program will blind them to missed sales opportunities and make them ever-more dependent upon Amazon.

Amazon might argue that indie ebooks today only account for a fraction of overall book industry sales. True, but that fraction is growing quickly as indies scale all the best-seller charts. This trend will continue as more and more professional authors turn their back on traditional book publishers in favor of self-publishing.

Amazon is smart. They understand indies are the future of book publishing. They also understand that by causing authors to remove their titles from distribution and lose sales rank (a key factor in ebook discoverability), they’ll severely limit competing retailers’ long term ability to drive sales for the authors.

European Commission and US Department of Justice Unwittingly Assist Amazon’s March toward Monopoly

Amazon’s new service offering comes at a time when the European Commission and even the US Department of Justice are scrutinizing the legality of agency ebook pricing. Agency ebook pricing (this blog post last year explains my company’s move to agency pricing, which, ironically, was necessitated by Amazon’s price matching practices) allows authors and publishers to set their own price and receive higher royalty rates. Amazon is a long time foe of agency, and as a result is probably enjoying a virtual wet dream as they savor the implications of potential restrictions against the agency model.

If agency pricing is limited or overturned, it would allow Amazon to engage in predatory pricing by selling ebooks at below cost in an effort to drive current and future competitors out of the market. It’s ironic that the EC and US DOJ are pursuing these ill-advised campaigns that could lead to less competition in the ebook market, not more.

What the EC and US DOJ fail to realize is that big publishers (the target of these investigations), which (I agree) price their books too high, are becoming less relevant to the future of book publishing as authors lose faith in the myth of big publishing. The problem of high prices from big publishers is not an agency pricing issue, it’s a problem of big publishers pricing their books too high.

Agency Pricing Enables Indie Authors and Small Publishers to Lower Prices

Despite fears to the contrary, we see evidence at Smashwords that agency pricing might actually encourage lower book prices. Indies, which are enjoying great benefits from the agency model (my company only distributes to agency retailers), are using agency to offer customers lower prices, not higher prices. The average ebook at Smashwords is priced under $5.00, and we have over 15,000 books priced at FREE. Why do indies price their books lower when they have the freedom to charge anything they want? The reason is that indies realize that consumers appreciate low prices, and as a result these lower prices give indies a competitive advantage over the large publishers.

When an indie author can earn 60-70% of list with agency pricing, they can set a lower price yet still earn more per book sold than if the book was sold under a wholesale pricing model (where the royalty would equal 43-50% of list). As an example, if an author wants to earn $2.00 from each book they sell, at a 70% agency rate they’d price the book at $2.85. Under the wholesale model (50% discount off list), they’d need to price the same book at $4.00 to earn $2.00.

The agency model puts profits in the pockets of the author or publisher, where it belongs, while allowing the retailer to earn a fair profit. Agency pricing relieves retailers from the pressure of competing on price. Instead, agency retailers compete on customer experience, such as creating discovery tools and recommendation systems that help match readers with the books they’d enjoy reading.

How should indie authors respond to Amazon’s KDP Select program? Horror might be a good start. It’s in every author’s best interest to support the development of a vibrant and competitive global ebook retailing ecosystem. With the democratized distribution enabled by indie ebooks, authors should distribute their books to as many retailers as possible. A world of many ebook retailers, all working to connect readers with books, is much preferable to a world where a single retailer restricts access to books.

In the interest of full disclosure, I am not an impartial observer. I have a horse in this game. Smashwords is the world’s largest distributor of indie ebooks. We publish and distribute over 90,000 ebooks from 33,000 indie authors and small presses around the world. We exist to serve our authors and publishers by distributing their titles to retailers such as the Apple iBookstore, Barnes & Noble, Sony, Kobo, the Diesel eBook Store and others. In other words, we supply Amazon’s competitors. We also distribute a small number of titles to Amazon. CAIRO: An Islamic cleric residing in Europe said that women should not be close to bananas or cucumbers, in order to avoid any “sexual thoughts.”

The unnamed sheikh, who was featured in an article on el-Senousa news, was quoted saying that if women wish to eat them, a third party, preferably a male related to them such as their a father or husband, should cut the items into small pieces and serve.

He said that these foods “resemble the male penis” and hence could arouse women or “make them think of sex.”
He also added carrots and zucchini to the list of forbidden items.

SEIU Union President Mary Kay Henry Arrested On Brooklyn Bridge Supporting Occupy Wall Street ProtestsPosted on November 18, 2011

“Moments like this make my job easy. I have been writing and producing video evidence that super-union SEIU planned the Occupy Wall Street movement for two months now. I have been doing this to refute false claims being made by Big Media outlets like ABC News and Time Magazine who have consistently reported that OWS is a “leaderless” movement, a spontaneous uprising of the people.” These reports are false.

SEIU, funded by George Soros money, has been planning OWS since at least March of this year, when former SEIU executive Stephen Lerner was videotaped imploring a union audience in Seattle that “we need to create a crisis” which would disable and dismantle the US banking system.

Andy Stern, an SEIU leader, has personally visited Barack Obama at the White House more than 22 times since Obama took office in 2009.

It was SEIU lobbyists hammering Congress for months on end, who the ones responsible for the passage of the only two pieces of legislation to come out of the first term of Barack Obama’s presidency: the 2009 Financial Recovery Act, [ aka the bank bail out bill ] and Obamacare. If you want to know who has really been running the country for the past three years look no further than SEIU.

Last night the current president of SEIU, Mary Kay Henry, was arrested on the Brooklyn Bridge while marching with the protesters and confronting police.

“…Building a new movement for social and economic justice in our country …” Is this “new movement” that Mary Kay refers to a socialist or communist movement? What is the REAL objective of SEIU in endorsing #OWS and Obama in 2012?

I believe there should be a formal investigation into the relationship between SEIU, Barack Obama and the Occupy Movement. When the movement tips the brink and falls over into open revolution against the government of the nation, there should be a legal precedent to take action. Our constitution states that the highest office in the land has a duty to protect our nation from all enemies, both without, and within.Barack Obama has been doing just the opposite. I would venture to say that the Occupy Movement was planned and nurtured during those many meetings Obama had with Andy Stern in 2009 and 2010. There needs to be a formal congressional investigation of what took place in those meetings between Andy Stern and Barack Obama in 2009, 2010, and the minutes thereof need to be made public. All of it needs to be aired.

It’s time to call for an investigation of SEIU and what has been going on behind the scenes that has led to people spilling into the streets, many thousands of them not even having the vaguest idea what it is they are really protesting about.

I see what SEIU is doing to instigate violence uprising in the streets as a clear and present danger to the republic of the United States of America.

THAT is the truth and the heart of it.

All over the world those who have traded in fraud and criminal acts, engaging upon subversion for serf-sering goals and purposes, one by one are hitting the skids and they have nothing to fall back on.

There is an increase of truth coming into the open despite the owned and controlled propaganda from the subversive media bases.
It all looks threatening and confusing, but when people with courage and initiative bring the truth, initially you get confusion and step by step that clears and things move to a better base.

Each part of the malicious subversive intent that lies behind the visible public outcry of “useful idiots” is coming to light. Intent to commit murder, fraud and criminal acts of harm are all part of the subversion.
